Acceptance
These Terms and Conditions apply to Realty Career Advocates, LLC and its website located at RealtyConnection.com. For the purpose of this document, both Realty Career Advocates, LLC and RealtyConnection.com can be used interchangeably and collectively be referred to as “RealtyConnection.com”, “we”, “us”, or “our” as required by the context. In addition, “Members” refers to any business advertised on our website, even if not service related. These include but are not limited to Real estate Companies, Mortgage Companies, Title Companies, etc. By using the suite of RealtyConnection.com services, you agree, without limitation or qualification, to be bound by, and to comply with, these Terms and Conditions and any other posted guidelines or rules applicable to any RealtyConnection.com services. All such guidelines and rules are hereby incorporated by reference into the Terms and Conditions. If a member refuses to be bound by any future provisions or amendments to these terms and conditions, the client will have the option to cancel their membership as of the renewal date (see cancellation policy for correct procedure).
Profile Maintenance
RealtyConnection.com shall not be held liable or responsible in any way for Members negligence in maintaining and updating their user profile, including but not limited to contact information, service information, coupons, discounts, etc. Member is responsible for keeping information current. Member also agrees that providing false information or phony coupons is strictly prohibited. Member also agrees and represents that they have the written permission from their company to use, upload, or advertise any logos, images, text copy, and business information within their profile on our website. RealtyConnection.com is not responsible at any time for the misuse of trademarks and copyrights on individual profiles or coupons and it is understood that you as the Member will be held liable for such damages including attorney fees should this issue occur. You hereby agree to provide true and accurate information with reference to insurance, bonds, awards, and any and all information within your profile.
Billing and Renewal Policy
Most RealtyConnection.com services are offered on a monthly agreement. The initial prices for these products or services will be established in the checkout page on RealtyConnection.com. RealtyConnection.com reserves the right to change the pricing for the different services and products at any time with 30 days notice. You will be bound by this new pricing upon renewal of any monthly or annual services after the 30 day notice period.
It is your, the account holders, responsibility to provide RealtyConnection.com with a valid credit card number and authorize RealtyConnection.com to charge this account for any products or services provided to you. You agree to keep RealtyConnection.com updated with current credit card information and provide new credit card information in the case that your old card is deactivated or has insufficient funds to cover your membership fees.
RealtyConnection.com does reserve the right to place your account on hold, deactivate your services, or terminate the agreement if your account falls into arrears. If the member has an outstanding balance at the time of termination or cancellation, this balance must be paid in full.
RealtyConnection.com services are billed in advance on a pre-paid basis and will automatically renew for additional periods of equal length on a month to month or annual basis depending on your selection. Billing dates take place on business days and if your month to month or annual anniversary falls on a weekend, our systems will automatically process your payment on the previous business day.
In the event that you wish to dispute any fee RealtyConnection.com has charged against your account, you agree to discuss the issue with RealtyConnection.com in order to resolve the issue.
Declined, refused, and/or returned payments may result in a $25.00 service fee to your account for each billing event that is declined, refused or returned. In the event your credit card declines or payment not made within agreed upon period or if you file a dispute without first attempting to correct a billing concern with RealtyConnection.com member services - documented by an open accounting ticket - your account will be disabled immediately and the leads generated by RealtyConnection.com system will become the property of RealtyConnection.com after 30 days if your account is not brought current and paid in full for the period service was rendered.
Cancellations
The purpose of this policy is to protect the rights of the member as well as RealtyConnection.com. It prevents others from maliciously canceling a Client's account and also provides the Client and RealtyConnection.com with written documentation of the member’s intent to cancel.
RealtyConnection.com will not honor cancellation requests made via voice mail. Instead, cancellations must be requested and received either in writing by postal mail sent to Realty Connection, LLC, 720 Kipling Street, Denver, Colorado 80215, or via email sent tocancellation@realtyconnection.com. In some cases RealtyConnection.com will verbally contact the member to ensure that the account cancellation was not requested by someone other than you, the member.
Members have the right to cancel their account at any time, however services are billed in whole billing periods only. If a member wishes to cancel their account part way through their billing cycle, either monthly, they will be charged for the entire billing cycle. Members will not, in any way, be prorated for unused time on their agreement.
Cancellation requests must be received no less than 10 days prior to the end of your billing cycle term. In circumstances where you do not cancel your account prior to the renewal date you are liable for payment of the entire term of 1 or 12 months.
NOTE: Set-up fees are not refundable.
Once the member has requested to terminate their account RealtyConnection.com will cease to provide any support to the members account or website once the billing cycle has ended. This includes, but is not limited, to domain services, technical services, and/or customer services. Any links or graphic received from RealtyConnection.com must be immediately removed from the website of the terminated member.
Parent Company/Franchisors - Multiple Branch/Franchisee Upload
Definitions:
a) Branch/Franchise/Office is an interchangeable term and is defined as an individual branch or franchise under the umbrella of Parent Company/Franchisor.
b) Parent Company/Franchisor is defined as corporate entity with authority to create profile for multiple branches/franchisees and is an interchangeable term for the purposes of this agreement.
c) Parent profile is the administration panel utilized by a Parent Company/Franchisor for the purpose of creation of multiple office profiles.
Authority
- Administrator creating Parent Company/Franchisor profile is representing they have the authority and permission to create account/profile and publish information, including but not limited to logo, compensation plans, marketing tools, production volume, etc., about their company on a public website (RealtyConnection.com).
Procedure
- Administrator creates Parent profile on Realty Connection by going to “List your Firm with Us” on home page, then click on to “Create Corporate/Franchisor Account for FREE”.
- Administrator activates Parent profile when Activation email is received.
- Administrator downloads Excel sheet from Realty Connection and enters contact information including branch name, branch address, Managing Broker name, Managing Broker email, phone, recruiting contact email (if different from Managing Broker). Once completed, email to linda@realtyconnection.com.
- Administrator creates Parent profile by logging into Realty Connection with the credentials received on Activation email. Administrator can choose which items are or are not editable by each branch office.
- Do not edit the “Additional Offices” tab as we will do this for you via upload of Excel sheet.
- Realty Connection requires a minimum of 50 points for Profile to be published. Points are obtained by completion of all required fields.
Content Input
- Administrator of Parent profile is responsible for creation of branch/franchisee profiles, for allowing or disallowing editing capabilities by branch/franchisee, and auto-population to individual branch/franchisee profiles. Individual branches/franchisees are responsible for content, content updates, links and all editable items on individual profiles.
- Branch/Franchisor has no responsibility for any content or edits made by a branch.
- Notwithstanding the above, Realty Connection understands that Franchisees at all times retain complete control of their day-to-day business operations and Franchisor has no control or supervision over Franchisees or their respective employees, agents, affiliates or otherwise. Because Franchisor Franchisees are independent parties, neither has the right to assume, create or enlarge any obligation or commitment on behalf of the other. Accordingly, under no circumstances shall anything herein be construed to obligate Franchisees to participate in or otherwise be actively involved in engaging in the purposes of this contract. This Agreement shall not in any manner whatsoever imply or otherwise create any relationship of agency, partnership, employment or otherwise as between Franchisor and Franchisees.
Privacy
- Realty Connection does not share branch information with third parties (see Realty Connection Privacy Policy)
Cost
- There is no cost to create a Parent profile, it is FREE forever
- Each branch is created with an Enhanced Profile (by default) and will never be charged for this level of membership.
- Each branch can choose to upgrade to a Premium profile at their discretion and enter individual payment information (office paid).
- Administrator (Corporate office) may choose to upgrade all or some branches to Premium profiles and do so on the Parent profile. Corporate paid pricing is determined by contacting Realty Connection and is determined by factors such as number of offices, etc.
Payment
- Parent Companies/Franchisors may pay for each branch/office/franchisee, but payment terms shall be handled separately and implemented by Realty Connection staff. Payments are month to month, or annually depending on terms agreed upon.
Support Policy
Customer support is available to members in good standing via email, live chat, and telephone. Our customer care support hours are as follows:

RealtyConnection.com expects you, the member, to have a rudimentary understanding of the manner in which the tools and services purchased from RealtyConnection.com function. The RealtyConnection.com customer support team does not assume any responsibility in teaching or training you in the use of the products and services you purchased. Online training guides and FAQ's are available to users, free of charge, on the RealtyConnection.com website.
If you or your clients experience technical difficulties, including but not limited to error messages or improper functioning, support will be provided at no charge to you, the member. Any other requests for support, custom work, and training will be billed to the client based upon the current RealtyConnection.com pricing for such services.
RealtyConnection.com Commercial Email (SPAM) Policy
For the protection of all members using the RealtyConnection.com suite of services, RealtyConnection.com is committed to maintaining a SPAM free environment. Improper and irresponsible use of the email tools through RealtyConnection.com can result in the entire population of members of our tools being blocked or filtered from sending emails to certain email service providers.
RealtyConnection.com stresses that you follow responsible permission based email marketing standards. You must agree to follow all provisions of the CAN-SPAM, which can be read in entirety here:

RealtyConnection.com does not accept responsibility for the consequences of members whose actions might have resulted in the blocking or filtering of RealtyConnection.com system emails to email service providers. RealtyConnection.com will monitor the email actions of users of the system in the case of SPAM compliance complaints and are authorized to terminate the agreement of members who continue to violate RealtyConnection.com SPAM policy. If your account is terminated or deactivated due to infringement of the RealtyConnection.com SPAM policy you may be subject to a $50 reactivation fee.
Accounts canceled due to SPAM could be billed a clean up fee of $100.
Website Vandalism
Please understand that RealtyConnection.com only considers a "hacked" account to be the unauthorized access of an account resulting from the criminal act of distributing and propagating a keylogger, Trojan, or other computer virus. We do not recognize a "hacked" account to be theft resulting from any sort of account sharing. The integrity, security and interactions on an account are the sole responsibility of the account owner, and not RealtyConnection.com. Any settings lost in this incident will not be restored. Owners are responsible for maintaining the confidentiality of their passwords and security of their accounts at all times.
The act of writing and distributing malicious code is a criminal act, one that the police will often investigate. A victim will need to contact his or her local authorities in order to report this activity. Because the actual crime was committed on the user's system, and not a system owned by RealtyConnection.com, we cannot file the report on behalf of the user.
During the investigation, police will likely need to contact us with a subpoena request to identify and track down the perpetrators. This can be done by writing RealtyConnection.com at the contact below:

Ownership of Services
RealtyConnection.com (or its affiliates) is the exclusive owner of the services and your use of the services does not provide you any right or interest in any RealtyConnection.com intellectual property including, but not limited to, common designs, layouts, content, program code, scripts, database structures, proprietary strategies and processes, and other intellectual property of RealtyConnection.com (or its affiliates). You may copy and reuse content and/or graphics designed specifically for you RealtyConnection.com; provided, however, that all source files for such content and/or graphics remain the exclusive property of RealtyConnection.com and such source files will not be provided to you or your representatives for copy, modification or reuse. A RealtyConnection.com copyright mark, logo and hyperlink will be placed on all publicly accessible web pages included in the services. Additionally, under no circumstances are you allowed to modify any link that RealtyConnection.com provides to you without express permission from RealtyConnection.com. Any violation of this policy could result in a fine or termination of your RealtyConnection.com services.
Lead Confidentiality
It is the intention of RealtyConnection.com to connect Real Estate Professionals or “Agents” with our Members for the purpose of recruiting or establishing a business relationship. Upon registration, agents are assigned a membership ID number which allows the agent to remain anonymous. It is understood that RealtyConnection.com will share this membership ID, along with any other information agent allows with our Members. RealtyConnection.com is not liable or responsible for any damages should an agent contact a Member outside of the RealtyConnection.com website. If agents change their default privacy settings, agents authorize RealtyConnection.com to provide contact information to Members for the purpose of encouraging a business relationship.
Content
Any and all services and products provided by RealtyConnection.com can be used only for legal purposes under all international, federal, provincial and municipal laws. Violations of this or any other provision of this agreement can result in a suspension of service leading to termination or RealtyConnection.com ‘s sole discretion, an immediate termination of service. This includes, but is not limited to:
Infringement of copyright, trademark, patent, trade secret or other intellectual property right Mail fraud, marketing schemes, or fraudulent activities, sending of unsolicited email, mail bombs, or any virus transmitted via email, using any RealtyConnection.com service or product for the purpose of participating in any activity dealing with subject matters that are prohibited under applicable law is prohibited.
Any illegal activity, including adult content, links to adult content web sites, online gambling, spamming or hacking will result in your site being shut down.
RealtyConnection.com does not host sites of its competitors or web pages promoting sites of its competitors.
RealtyConnection.com will be the sole arbiter as to what constitutes a violation of this provision.
Content Disclaimer
RealtyConnection.com communicates information provided and created by advertisers, content partners, software developers, publishers, marketing agents, employees, users, resellers and other third parties. RealtyConnection.com has no control over the accuracy of such information on our pages, and material on the RealtyConnection.com Web site may include technical inaccuracies or typographical errors.
We make no guarantees, nor can we be responsible for any such information, including its currency, content, quality, copyright compliance or legality, or any resulting loss or damage.
The Realty Connection Site and the content are provided on an "as is" basis. Some information provided on the Realty Connection Site is provided by third party licensors, as a result Realty Connection disclaims any knowledge as to the accuracy and veracity of the information provided by its licensors. REALTY CONNECTION, ITS LICENSORS, AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. Without limiting the foregoing, Realty Connection, its licensors, and its suppliers make no representations or warranties about the following:
1. The accuracy, reliability, completeness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the Realty Connection Site or Realty Connection.
2. The satisfaction of any government regulations requiring disclosure of information or the approval or compliance of any software tools with regard to the Content contained on the Realty Connection Site.
In no event shall Realty Connection, its licensors, its suppliers, or any third parties mentioned on the Realty Connection Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Realty Connection Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not Realty Connection, its licensors, its suppliers, or any third parties mentioned on the Realty Connection site are advised of the possibility of such damages. Realty Connection, its licensors, its suppliers, or any third parties mentioned on the Realty Connection Site shall be liable only to the extent of actual damages incurred by you, not to exceed U.S. Realty Connection, its licensors, its suppliers, or any third parties mentioned on the Realty Connection Site are not liable for any personal injury, including death, caused by your use or misuse of the Site, Content, or Public Areas (as defined below). Any claims arising in connection with your use of the Site, any Content, or the Public Areas must be brought within one (1) year of the date of the event giving rise to such action occurred. Realty Connection also may select certain sites as priority responses to search terms you enter and Realty Connection may agree to allow advertisers to respond to certain search terms with advertisements or sponsored content. Realty Connection does not recommend and does not endorse the content on any third-party websites. Realty Connection is not responsible for the content of linked third-party sites, sites framed within the Realty Connection Site, third-party sites provided as search results, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. Realty Connection does not endorse any product, service, or treatment advertised on the Realty Connection Site.
All of the data on Members including but not limited to, the compensation plans, fees, or any feature thereof, is subject to change without notice by the party providing the data. You should use discretion while browsing the Internet.
RealtyConnection.com reserves the right, in its sole discretion and without any obligation, to make improvements to, or correct any error or omissions in, any portion of the Sites. Where appropriate, we will endeavor to update information listed on the Web site on a timely basis, but shall not be liable for any inaccuracies.
Links to external Internet sites are provided within the content on the Site as a convenience to users. The listing of an external site does not imply endorsement of the site RealtyConnection.com or its affiliates. Indemnification
As a client, you agree not to harm RealtyConnection.com, its reputation, computer systems, programming and/or other Account Holders using RealtyConnection.com services. If the client breaches this Agreement, then RealtyConnection.com has the right to terminate service without any refunds of the unused portion prepaid by the client.
RealtyConnection.com does not offer any warranty or guarantee other than those expressly stated in the Terms of Service.
RealtyConnection.com reserves the right to amend our Terms and Conditions at any time and without notice.
Right to Refuse Service
RealtyConnection.com reserves the right to refuse services to any client. In the event that a client does not abide by the provisions set out in this agreement or if RealtyConnection.com deems the client to be a hindrance to RealtyConnection.com, the client will be blacklisted RealtyConnection.com will not provide any services to the client in the future
We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law.
RealtyConnection.com reserves the right to refuse services to any potential client, even before any services have been provided to the client.
Trademarks
RealtyConnection.com, its successors and assignees own and have the exclusive use of the RealtyConnection.com and service, trademark and logo. Unauthorized use of any RealtyConnection.com or service, trademark or logo is a violation of federal and state trademark laws.
